These Terms of Use (“Terms”) govern your access to and use of the AirPosture mobile application (the “App”) provided by Avlabs Dijital Hizmetler Anonim Sirketi (“AVLabs”, “we”, “our”, or “us”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. The Service

AirPosture helps you monitor posture using sensors on your iPhone and, when available, compatible AirPods. Features may include live tracking, session history, insights, reminders, and related tools. We may update, change, suspend, or discontinue features at any time.

3. Eligibility

You must be able to form a binding contract under applicable law and meet the minimum age required in your country (and at least 13 years old, or higher if required locally).

4. Health and Safety Disclaimer

Use the App in a safe environment. Do not use tracking features in situations where attention to surroundings is required for safety.

5. Account and Device Access

• You are responsible for maintaining control of your device and Apple ID
• You are responsible for activity that occurs through your use of the App on your device
• We may create a technical user identifier to operate analytics, subscriptions, and App features

6. Subscriptions and Purchases

• Certain features may require a paid subscription (for example weekly or yearly plans)
• Payments are processed by Apple through your Apple ID
• Subscription terms, price, trial (if any), renewal, and cancellation are shown in the App and/or App Store product page at purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period, in accordance with Apple’s rules
• Manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions
• Refunds are handled by Apple under Apple’s refund policies, unless mandatory local law says otherwise

7. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices you own or control, as permitted by the App Store Terms of Use.

You may not copy, modify, distribute, sell, or lease any part of the App; reverse engineer it except where allowed by law; circumvent security or paywalls; or use the App for unlawful or abusive purposes.

8. Intellectual Property

The App, including its design, text, graphics, logos, software, and content (excluding your personal session data), is owned by AVLabs or its licensors and protected by intellectual property laws.

9. Privacy

Your use of the App is also governed by our Privacy Policy.

10. Third-Party Services and Devices

The App may rely on third-party platforms and services (for example Apple, analytics, attribution, and subscription infrastructure) and on hardware such as AirPods. We are not responsible for third-party products, services, outages, or policies. Compatible AirPods and motion features may vary by device model and iOS version.

11. Availability

We strive for reliable service but do not guarantee uninterrupted or error-free operation. Features that depend on sensors, permissions, background modes, or connected accessories may be limited if permissions are denied or hardware is unavailable.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that posture estimates will be accurate, complete, or suitable for any specific health purpose.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVLABS AND ITS DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP SUBSCRIPTION IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 50, EXCEPT WHERE PROHIBITED BY LAW.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless AVLabs from claims, damages, losses, and expenses arising from your misuse of the App or violation of these Terms.

15. Termination

You may stop using the App at any time and cancel subscriptions through Apple. We may suspend or terminate access if you violate these Terms or if we discontinue the App.

16. App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and AVLabs, not Apple; Apple has no obligation to provide maintenance or support for the App; and Apple is a third-party beneficiary of these Terms regarding your use of the App.

17. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise.

18. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms and change the “Last Updated” date. Continued use of the App after the update constitutes acceptance, except where additional consent is required by law.
