1. Acceptance of Terms
By accessing or using the Weight ScaleAI application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Weight ScaleAI is a mobile application that uses computer vision and artificial intelligence to provide weight, measurement, and other analysis features for objects captured via camera or selected from the device gallery.
3. Registration and User Accounts
3.1. Some features of the App may require you to register for an account. You agree to provide accurate, current, and complete information during the registration process.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. You must immediately notify Weight ScaleAI of any unauthorized use of your account or any other breach of security.
4. User Content
4.1. The App may allow you to capture, upload, and store images ("User Content").
4.2. You retain all rights to your User Content, but grant Weight ScaleAI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit such User Content for the purpose of operating and improving the App.
4.3. You represent and warrant that your User Content does not violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
5. Privacy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.
6. Prohibited Activities
You agree not to:
6.1. Use the App for any illegal purpose or in violation of any laws.
6.2. Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App.
6.3. Upload invalid data, viruses, worms, or other software agents through the App.
6.4. Use any robot, spider, crawler, scraper, or other automated means to access the App.
6.5. Impersonate another person or access another user's account without permission.
7. Intellectual Property Rights
7.1. The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Weight ScaleAI and its licensors.
7.2. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Weight ScaleAI.
8. Disclaimer of Warranties
8.1. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.2. WHILE WE STRIVE FOR ACCURACY, WE MAKE NO GUARANTEE THAT THE MEASUREMENT AND ANALYSIS FEATURES OF THE APP WILL BE 100% ACCURATE. THE APP IS NOT INTENDED FOR USE IN SITUATIONS WHERE PRECISE MEASUREMENTS ARE CRITICAL.
9. Limitation of Liability
IN NO EVENT SHALL Weight ScaleAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
10. Indemnification
You agree to defend, indemnify, and hold harmless Weight ScaleAI and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
11. Modifications to the Service and Terms
11.1. Weight ScaleAI reserves the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice.
11.2. We may revise these Terms from time to time. The most current version will always be on the App. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
13. Termination
13.1. We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
13.2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
