Definitions

• "App" means the Carzie iOS mobile application.
• "User," "you," or "your" refers to any individual who uses the App.
• "Content" means any photos or other materials you upload to the App.
• "Generated content" means the images and videos our AI models create based on your uploaded Content.
• "Credits" means the virtual, purchasable, or subscription-earned units spent to run a generation in the App.
• "Service" means all features and functionality provided through the App.

Eligibility

To use Carzie, you must:

• Be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher)
• Have the legal capacity to enter into a binding agreement
• Comply with all applicable laws and regulations in your jurisdiction

If you're under 18, you confirm you have permission from a parent or legal guardian to use the App.

License to use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device for personal, non-commercial use.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, sell, or sublicense the App to third parties
• Remove or alter any copyright, trademark, or proprietary notices in the App
• Use the App for any unlawful or unauthorized purpose

Acceptable use policy

You agree to use the App responsibly and in compliance with applicable law. You agree not to:

• Upload illegal or harmful content: photos or content that are illegal, defamatory, harassing, fraudulent, obscene, or otherwise objectionable.
• Violate intellectual property rights: upload photos or content you don't own or have the right to use (copyrighted images, someone else's vehicle without permission, etc.).
• Impersonate others: use the App to impersonate a person or entity or misrepresent your affiliation.
• Interfere with the service: attempt to disrupt, hack, or interfere with the App's operation, security, or infrastructure.
• Create harmful or offensive content: generate images that promote hate, violence, or discrimination.
• Use for deceptive purposes: use generated content to deceive or mislead others (e.g., fabricating identification documents).

We reserve the right to suspend or terminate your access to the App if you violate this Acceptable Use Policy.

Content ownership and license

5.1 Your content

You retain all ownership rights to the photos and content you upload ("Your Content"). By uploading Your Content, you represent and warrant that:

• You own all rights to Your Content, or have obtained all necessary permissions to use it
• Your Content doesn't violate any third-party rights (copyright, trademark, privacy, or publicity)
• Your Content complies with all applicable laws and these Terms

5.2 License you grant us

By uploading Your Content, you grant Carzie a limited, non-exclusive, worldwide license to:

• Store, process, and transmit Your Content to third-party AI providers to generate the content you requested
• Display Your Content and generated content to you within the App
• Use Your Content as necessary to provide, maintain, and improve the Service

5.3 Generated content

You own the images and videos generated from Your Content. You're free to download, use, and share them, subject to: you may not use generated content for illegal, harmful, or deceptive purposes; and you acknowledge AI-generated output may have limitations in accuracy, quality, or appropriateness.

Subscriptions, credits & payments

6.1 Paid features

Carzie offers both free and paid tiers. Credits used for generation are earned through an auto-renewing subscription (weekly/annual) or purchased as one-time credit packs. All purchases are processed through Apple's in-app purchase system.

6.2 Billing

All payments are handled by Apple. Subscriptions automatically renew at the end of each billing period unless canceled; Apple charges the payment method on file.

6.3 Cancellation and refunds

You can cancel your subscription at any time through your Apple ID settings; cancellation takes effect at the end of the current billing period. Refunds are subject to Apple's refund policy — we don't process refunds directly. Please submit refund requests through reportaproblem.apple.com.

6.4 Price changes

We may change subscription prices from time to time. Price changes won't affect your current subscription until renewal; we'll notify you of changes in advance.

Disclaimers

7.1 "As is"

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We don't warrant that the App will be uninterrupted, secure, or error-free, that AI-generated results will meet your expectations, or that all features will always be available.

7.2 AI-generated content

Generated images and videos are created by machine learning algorithms and may not always be accurate, appropriate, or fit for every purpose. You use generated content at your own risk.

7.3 Third-party services

The App relies on third-party AI services. We're not responsible for the availability, performance, or privacy practices of these third-party services.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Carzie AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the App
• Damages related to generated content or third-party services

Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to liability, or $100 USD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Carzie and its affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or generated content

Termination

10.1 By you

You may stop using the App at any time by deleting it from your device. To cancel a paid subscription, use your Apple ID settings.

10.2 By us

We reserve the right to suspend or terminate your access at any time, without notice, if you violate these Terms or our Acceptable Use Policy, if required by law, or if we discontinue the App.

10.3 Effect of termination

Upon termination, your right to use the App ceases immediately. We may delete your Content and generated content from our servers. Sections that by their nature should survive (disclaimers, limitation of liability, indemnification) remain in effect.

Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Türkiye. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of Türkiye, as applicable.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last Updated" date above and notify you of material changes within the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

General provisions

13.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Carzie and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.

13.4 Assignment

You may not assign these Terms or your rights without our prior written consent. We may assign these Terms without restriction.
